Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Akshaya Pathra Kitchen website, mobile-responsive ordering platform, and loyalty/wallet program (collectively, the "Service"). By creating an account, placing an order, or using any feature of the Service, you agree to these Terms.

Accounts

You may create an account using email, Google sign-in, or a phone number with a one-time verification code. You are responsible for maintaining the security of your sign-in credentials and for all activity under your account. You must provide accurate information and update it when it changes. Sharing your account with others is not permitted.

We may suspend or terminate accounts that violate these Terms, show signs of fraud, or attempt to abuse the loyalty/wallet program.

Ordering & Payment

Menu, item availability, pricing, and applicable taxes are set by the restaurant and may change at any time. The total shown at checkout is the authoritative amount you will be charged. Card payments are processed by Clover; we do not store full card numbers on our servers. Cash deposits to the wallet are accepted in-store only.

Once an order is paid and accepted by the kitchen, cancellation and modification depend on the order's current preparation status. Contact the restaurant directly for changes after an order has been submitted.

Refunds

Refunds for canceled, incomplete, or unsatisfactory orders are handled at the restaurant's discretion. Approved refunds are issued through the original payment method (card refund via Clover, or wallet credit). Wallet-funded payments may be refunded to wallet balance. Cash refunds are issued in-store.

Wallet & Loyalty Program

The wallet allows you to pre-load funds (in-store cash deposits only) that can be applied to future orders. Wallet balance has no cash value, is non-transferable, and may not be redeemed for cash except as required by law.

Loyalty points are earned on paid orders based on a multiplier set by your current tier. Tier upgrades are automatic when you cross the threshold for the next tier, based on lifetime net spend (sales minus refunds). Points have no cash value and cannot be transferred between accounts. Points may be redeemed for the rewards listed in your Rewards page at the time of redemption. We may adjust point balances or tier assignments to correct errors or address fraud.

We reserve the right to modify the wallet and loyalty programs, including the point earning rate, tier thresholds, available rewards, and bonus percentages, at any time. Existing balances will be honored at their current value.

Communications

When you create an account, we will send transactional email notifications about your orders and account by default. SMS text notifications are off by default and require your explicit opt-in (see our SMS Terms & Consent). You may change either preference at any time from your Profile page, or reply STOP to opt out of SMS.

Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to access another user's account, wallet, or order history
Reverse-engineer, scrape, or otherwise interfere with the normal operation of the Service
Exploit bugs, promotional codes, or loyalty/wallet mechanics in ways not intended by the program (including creating multiple accounts to claim bonuses)
Submit false, abusive, or harassing content through any input field

Intellectual Property

The Service, including its layout, design, logos, menu descriptions, and content, is owned by Akshaya Pathra Kitchen or its licensors. You may not copy, modify, distribute, or create derivative works without prior written permission, except for personal, non-commercial use of the Service as intended.

Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses, or that menu items, prices, or availability will be accurate at any given moment. Food preparation times are estimates and may vary.

Allergens: please review item descriptions and notify staff of any allergies. We cannot guarantee that any item is free of specific allergens due to shared kitchen equipment.

Limitation of Liability

To the maximum extent permitted by law, Akshaya Pathra Kitchen will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid Akshaya Pathra Kitchen in the three (3) months preceding the claim.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Material changes will be communicated via email or in-app notice to active users. Continued use of the Service after a change constitutes acceptance of the revised Terms.
